Subject : IT Patent Disputes Constitute 90% of All Patent Disputes |

It has been found that 9 out of 10 international patent disputes involving foreign companies are in the IT field. This means that Korean companies are very much exposed to patent attacks by foreign companies. It also means that Korean IT companies have weak patent management. This information was revealed in ¡®Patent Wars 2011¡¯ by the Electronic Times and Korean Intellectual Property Protection Association (KIPRA) at COEX, Samsung-dong, Seoul. According to the data revealed by the Korean Intellectual Property Office (KIPO) there were 36 international patent disputes this year where electrical/electronic field and information communication constitute 19 suits (53%) and 14 suits (39%) respectively. Thus, these two IT areas constitute 92% of all international patent disputes this year involving Korean companies. The other 3 suits were involving fabrics and chemicals. It appears that global patent trolls are targeting Korean companies that have excellent technological competence but relatively weak patent management. KIPO spokesperson stated that ¡°as our technological level increases and our world¡¯s market share improves, global companies are using their patents as weapons to compete with the Korean companies.¡± Targets were large Korean companies. From the 24 companies that face suits, 22 of them were large Korean companies. As they increased their market share with technological advancements and brand power, they became exposed to suits by global companies. American companies constitute 44.4% and Japanese companies constitute 22.2% of the suits filed against these Korean companies. The attendants of the ¡®Patent Wars 2011¡¯ all agreed that Korean companies must strengthen their patent management in order to guarantee future benefits. |
