As Apple, Inc. - one of the largest multinational corporations in the world most valued for its technological innovation - files a legal suit against Samsung Electronics for allegedly copying the design of its iPad and iPhone products, Samsung is fighting back by filing a counterclaim for patent infringement.

Samsung, South Korea¡¯s largest electronics maker, announced on Friday that it had submitted a complaint on Thursday against Apple Korea at the Seoul Central District Court for patent infringements and demands for compensation.

Similar suits were filed in the Japanese and German courts for Apple¡¯s patent breaches. More specifically, Samsung claimed five patent violations in the Seoul court, two violations in the Japanese court, and three violations in the German court for the iPhone and iPad product lines.

The Korean tech giant plans to submit a similar claim to the US court as well. Before doing so, however, Samsung will first answer Apple¡¯s accusations on design stealing by proving such allegations to be baseless and legally indefensible. The counterclaim will come in the next two to three months, after the Korean company successfully defends against Apple¡¯s attacks.

¡°First, we will be striking back in the three countries of Korea, Japan, and Germany. In the US, we will need to ward off Apple¡¯s allegations before we submit our own complaints,¡± explained Samsung.

Samsung had cited breaches against its telecommunications patents for the legal battle against Apple, most probably because the Korean company holds a comparative advantage in the field. Samsung is the largest foreign company in the US in terms of patent registrations, and takes a bulk of the nation¡¯s mobile phone-related technological patents. Apple, on the other hand, has a relatively weak patent base for hardware technology.
