Subject : Cheil Industries Beat Cabot in Patent Infringement Lawsuit |

South Korea¡¯s Samsung Cheil Industries Inc. stated that the company won an appeal case against U.S.-based Cabot Microelectronics over infringement of patent for wafer abrasive used for semiconductors.
Consequently, the company will be able to provide a stable supply of wafer abrasive in semi-conductor material market in the near future as Cabot¡¯s appeal was overruled at the end of 2009. Seoul High Court dismissed Cabot¡¯s appeal over a ruling by Seoul Central District Court that the company did not infringe the patent rights. The high court said that the company¡¯ product belongs to ¡°free technology¡± category, indicating anyone with enough knowledge in the manufacturing technology for semi-conductor¡¯s substrate is free to use the technology.
The legal battle was triggered by Slurry which is an abrasive substance used to polish wafer in a bid to compose circuit in semi-conductor. It is classified as a core material technology of high-integration for semi-conductors.
The company entered the wafer abrasive market with the help from Samsung Electronics back in 2003. Back then, the market was dominated by U.S.-based Cabot Microelectronics and Japan¡¯s Hitachi.
Cabot Microelectronics, the leader in the field, filed a lawsuit against the comapny in July 2007 for patent infringement. The company filed a counter-suit annulling the lawsuit by Cabot to the Korean Intellectual Property Tribunal. On the first instance, the tribunal ruled in favor of the company in August 2008 and the second instance is currently underway. |
