LED manufacturer Seoul Semiconductor got sued by Philips for patent infringement.
According to a report made on 8 May, lighting company Philips and its LED subsidiary Philips Lumileds Lighting Company filed an LED patent lawsuit against LED maker Seoul Semiconductor Company Ltd.
The lawsuit was filed on 4 March in the U.S. District Court for the Central District of California, which claimed infringement of five patents owned by Lumileds.
Philips is also seeking a declaratory judgment that a patent assigned to Seoul Semiconductor is invalid.
The complaint claims that a range of Seoul Semiconductor products infringe on Philips¡¯ patents, including Acriche (e.g. A2, A3, A4), Top View (e.g. KWT801-S, SFT-722N-S), High Flux, Side View (e.g. SWAA07, SWAA05), and Z-Power (e.g. Z1, Z5, P4, P7, P9).
The five patents owned by Philips Lumileds that are in issue here are patent no. 6,590,235 ¡°high stability optical encapsulation and packaging for light-emitting diodes in the green, blue, and near-UV range,¡± no. 5,779,924 ¡°ordered interface texturing for a light emitting device,¡± no. 6,717,353 ¡°phosphor converted light emitting device,¡± no. 6,547,249 ¡°monolithic series/parallel led arrays formed on highly resistive substrates,¡± and no. 6,274,924 ¡°surface mountable LED package.¡±
Philips alleges that Seoul Semiconductor used these patents without authorization. It further stated that the ¡®742 patent is invalid and has no grounds here for suit.
The complaint states that ¡°SSC has engaged in a course of conduct that shows a preparedness and willingness to sue on the ¡®742 patent¡± and that the plaintiffs ¡°reasonably apprehend that they will be improperly sued by SSC on the ¡®742 patent.
¡± Seoul Semiconductor has not released an official statement regarding its future actions regarding the patent infringement suit.
Seoul Semiconductor is the no.1 LED manufacturer in South Korea and no.4 LED manufacturer in the World.
It has been involved in a similar patent infringement suit with Nichia in the past, which ended with cross-licensing in 2009.
